Terms of Service

Please read carefully. By creating an account or using the TargetBooker platform, you agree to these terms. If you don't agree, do not use the service.
1. About us
"TargetBooker", "we", "us" and "our" refer to the operator of the TargetBooker platform, accessed via targetbooker.com and app.targetbooker.com. Contact: support@targetbooker.com.
"You", "your", "the Venue" or "Subscriber" refers to the business or individual using the platform under a paid or trial subscription.
2. What the service does
TargetBooker is a software-as-a-service platform that lets activity venues take online bookings, manage schedules, collect participant disclaimers, take card payments (through third-party payment processors), and communicate with their customers via automated email.
The platform is provided on an "as available" basis. We aim for high uptime but do not guarantee uninterrupted or error-free service.
3. Accounts and subscription
3.1 Signing up
You must be at least 18 and authorised to enter into a contract on behalf of the venue you're registering. You must provide accurate business, contact and billing details, and keep them up to date.
3.2 Plans and pricing
Current plans and their included limits (participants per month, emails per month, activity count, storage) are shown on our pricing page. Prices are in GBP and may be updated with at least 30 days' notice for existing subscribers.
3.3 Overage
If your usage exceeds the included limits for your plan, you will be billed the overage rate shown on the pricing page for each extra participant. We may also throttle email sending once you reach your monthly cap.
3.4 Billing and payment
Subscriptions are billed monthly in advance via Stripe. Failed payments will be retried; if a payment remains unpaid after 7 days we may suspend access to the platform until it's resolved. If a subscription is unpaid for 30 days we may terminate the account.
3.5 Cancellation and refunds
You can cancel your subscription at any time from your admin dashboard. Cancellation takes effect at the end of the current billing period; no partial refund is given for the unused portion of a period. Prepaid annual plans are refundable only within the first 14 days.
4. Your responsibilities
- Compliance: You are responsible for making sure your bookings, cancellation policy, deposit policy, refund policy, and any waivers/disclaimers you publish comply with UK consumer-rights law (including the Consumer Rights Act 2015) and any applicable industry regulation.
- Your own T&Cs: You must publish your own terms and conditions for your customers, especially where you take deposits, apply auto-cancellation policies, or forfeit payment for missed balances. TargetBooker's platform provides the mechanics; you provide the legal basis your customers agree to.
- Data accuracy: The bookings, prices, availability and content you publish through the platform must be accurate and lawful.
- Payments: Card payments taken through the platform are processed by Stripe and/or PayPal under their own terms. You are responsible for keeping your Stripe/PayPal accounts in good standing.
- Staff access: You are responsible for who you invite to your admin dashboard and for the actions they take.
5. Acceptable use
You must not use the platform to:
- Take payments for goods or services you cannot legally sell.
- Send unsolicited marketing email in breach of UK PECR / GDPR rules.
- Store or transmit unlawful, obscene, defamatory or infringing content.
- Attempt to gain unauthorised access to other venues' data, or to any part of the platform.
- Reverse engineer, resell, or offer the platform as your own SaaS to other businesses.
Breach of this section may result in immediate suspension and/or termination.
6. Data ownership and processing
6.1 Your data
You retain ownership of your venue data and your customers' personal data. TargetBooker acts as a "data processor" on your behalf under UK GDPR, and you act as the "data controller" for your customers.
6.2 What we do with data
We process the personal data your customers submit (name, contact details, DOB where relevant, booking history) only to provide the platform to you — never for our own marketing, and never sold or shared with third parties beyond the sub-processors listed below.
6.3 Sub-processors
The platform runs on Vercel (hosting), Supabase (database and storage, based in the EU), Stripe (payments), PayPal (optional payments) and Resend (transactional email). By using TargetBooker you consent to your data being processed by these sub-processors under their own privacy policies.
6.4 Data retention
Participant disclaimer records are retained for the period appropriate to the participant's age at signing (up to 6 years for adults and until the participant's 21st birthday for minors, per your plan). Booking records are retained for the lifetime of your subscription plus a wind-down period.
6.5 Data export and deletion
On written request, we will provide an export of your venue data in a standard format. On termination, your data is retained for 30 days and then permanently deleted, except where retention is required by law.
7. Uptime and support
We target 99.5% availability, excluding scheduled maintenance (advised in advance where reasonable) and issues caused by third-party providers. Support is provided via email during UK business hours. There is no guaranteed response time on standard plans; enterprise plans may include an agreed SLA.
8. Intellectual property
The TargetBooker platform, name, logo, and all associated code and content remain our property. You are granted a non-exclusive, non-transferable licence to use the platform for the duration of your subscription. Content you upload (logos, images, PDFs) remains yours; you grant us the right to host and display it as part of providing the service.
9. Liability
Nothing in these terms limits either party's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited by law.
Subject to that:
- We are not liable for indirect, incidental or consequential losses, lost profits, lost goodwill, or lost bookings arising from your use of or inability to use the platform.
- Our total liability to you in any 12-month period is capped at the total subscription fees you paid us in that period.
- We are not responsible for issues caused by third-party services (Stripe, PayPal, Supabase, Vercel, Resend, your DNS provider, etc.) or by outages beyond our reasonable control.
10. Termination
Either party may terminate the agreement by giving 30 days' notice, or immediately in the case of material breach (including non-payment, breach of acceptable use, or unlawful conduct). On termination your access to the platform ends; see section 6.5 for what happens to your data.
11. Changes to these terms
We may update these terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance.
12. Governing law
These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
